Dixon Man in Court For His Crowing Roosters -- What Do You Think of the Charges?

Neftali Rivera Sr. is facing charges of disturbing the peace and maintaining a public nuisance on his rooster farm.

 

Neftali Rivera Sr. is facing two misdemeanor charges of disturbing the peace and maintaining a public nuisance on his property -- a rooster farm in Dixon. 

Solano County prosecutors are expected to wind down their case today, according to the Vacaville Reporter, which quotes Rivera's defense as saying the “complaints came from a ‘chronic complainer’ who has a ‘propensity to falsely complain about her neighbors.’”

Check out the Reporter story to read about a Solano County ordinance that limits the amount of roosters one can have on his/her property. The ordinance was approved in April of 2011.

Rivera was arrested the following month for failing to appear in court on these charges. Commissioner Barbara James had issues a warrant for his arrest.

The defense is expected to make its case starting Thursday.

THIS PERSONS NEIGHBOR.. HAS TO BE RELATED TO MY NEIGHBOR..... ANIMAL CONTROL WAS OUT HERE FOR 4-5 HOURS(BIG WASTE OF TIME) TRYING TO CATCH ROOSTERS... DURING THE DAY TIME.... HAHAH STUPID PEOPLE..... (THINK THEY CAUGHT ONE ROOSTER)... I THINK THIS IS SOOO STUPID... IM GUESSING THE FARMER HAS BEEN HERE LONGER THEN THE NEIGHBOR... SO U WOULD ONLY GUESS THAT THE NEIGHBOR WOULD KNOW OF THE SMELL AND NOISE.... AND JUST SO U ALL KNOW THE Commissioner(GLORIFIED JUDGE) THAT PUT OUT THE WARRANT IS ON A WATCHDOG LIST.... SHES BEEN CAUGHT DOING STUFF ILLEGAL AS ALL GET OUT...... SO BE AWARE

also i know The ordinance that was passed has not been fine-tuned...i know its different if the person has them for eating.. and i would only guess that's what he does.. sells them for food... so im sure the ordinance doesn't apply to that........

Can I have my 2 neighbors' dogs sited for public nuisance? They bark all the time. Ha ha.

If this neighnor is a cronic complainer, they should have spent so time checking it out before siting him. Rosters are not usually noisy so I bet the complaint is false

California Civil Code section 3482.5 Preexisting Agricultural Uses Not Nuisance. “(a)(1) No agricultural activity, operation, or facility, or appurtenances thereof, conducted or maintained for commercial purposes, and in a manner consistent with proper and accepted customs and standards, as established and followed by similar agricultural operations in the same locality, shall be or become a nuisance, private or public, due to any changed condition in or about the locality, after it has been in operation for more than three years if it was not a nuisance at the time it began.” County is liable for their agents’ “racketeering and extortion” in using threats, fear and intimidation by going door-to-door issuing citations for having too many parakeets, fish, frogs, goats, guinea pigs, fowl, pigeons, pigs, horses, etc., which information they obtained illegally through criminal trespass or violation of property owners’ Fourth Amendment.

"Roosters are not usually noisy." Wrong. I live next door to 8 of them and they crow for hours at a time.
